Complainant in this case is a small scale miner resident at Ametubuom, a suburb of Asiwa, whilst A1 is an Air force officer based at Acera, A2 is an Air force officer based at Tamale, but on course with A1 in Accra. A3 is a driver resident in Accra and an employee of Big Travels and Logistics, car renting company in Accra.

A4 and A5 now at large are military officers based in Kumasi. A3 after having meeting with A1, A2 and A4 and knowing very well that they were going to rob, he on 25 day of November, 2023 led them to the secretary of company and told him A1, A2 and A4 were going to effect an arrest at Konongo and wanted a car to rent.

GS 3236-17 was rented to them with A5 assigned to drive them.” They set off from Acera at about 2:00 pm and on reaching Konongo, they picked A5 also in military uniform. A4 who was alleged to be a native of Asiwa led them to Ametubuom, a community near Asiwa, into the complainant’s residence at about 1:30am.

Mentioning the complainant’s name they heavily knocked at his door, asking him to come out, The complainant with fear peeped through a hole in his door and not knowing them he refused opening the door. Evelyn Biago, the wife of Complainant, who was also in the room called Kwabena, a friend of the complainant, who lives nearby on phone and told him what was happening in their house and asked him to come and check, who were at their door.

Kwabena not knowing the danger awaiting him rushed into the house. Without him uttering a word the four military men attacked him and subjected him to severe beatings. The complainant who could not bear the pain of what his friend was going through opened the door and went out, The accused persons turned their attacked on him, pushed him backed into the room.

Accused persons amidst the beating of the complainant demanded each the sum of GHC 400,000.00 from him before they will release him. The complainant told them he was not having money, but for the fear for his life and that of his wife, called his mother in-law; who lives in the same house with them, for money. The mother in law gave him GHC 10,000.00 and he surrendered same to he accused persons.

The accused persons wasn’t satisfied continued beating the complainant as they were demanding for more. The complainant pleaded with the mother in-law to add more, if she had.
The mother -in law went back into her room and brought out additional GHC 20,000.00 rapped in a black polytene bag and handed same to accused persons.

The accused persons realized that the mother in-law had more money in the room, A2 pushed her into the room, ransacked the room and retrieved GHC 40,000.00 also in a polytene bag. They went back into the complainant’s room ransacked there also and had GHC 15,000.00.
They collected also an amount of GHC 7,000.00 from Kwabena and seize his motor bike key with the intention of preventing him from chasing them Still not satisfied with all their collections, they forcibly pushed the complainant into their vehicle, held him at ransom.

Whilst in the vehicle, A1 searched complainant and removed GHC 4,500.00 from his pocket. In total they robbed the complainant and his family an amount of GHC 96,500.00. Police had wind of in the incidence, organized and crossed the accused persons on the route they were plying. Police signaled them to stop, but they ignored them and speed off. Police shot at the vehicle, but the accused persons were not perturbed. They continued until they got to a

broken bridge at the Anwiam. As the the vehicle could not cross the broken bridge, they abandoned the vehicle and continued on foot into a forest still olding the complainant hostage. The folks from the communities around also had wind of the incidence and went searching for them, as the accused persons were in the bush with the victim and their booty, trying to find their way out.
At about 4:30am the A1 and A2 appeared at Anumse town trying to look for vehicle to escaped and they were spotted and arrested by the town folks and later handed over to Police.

As A4 and A5 waited for A1 and A2 and they were not returning, they abandoned the complainant and fled through the forest. A3 was later arrested in Abunkwah forest at Anumso. During investigations they all admitted the offences as A2 mentioned A4 as Frimpong and A5 as Francis, all military men based in Kumasi.
A1 also told Police that the monies collected, which were in his bag, were taken away by the town folks, who arrested them. Later one body amour, a crutch that complainant uses as an aid for walking and a motor bike ignition keys the accused person seized from Kwabena were retrieved from where they were hiding in the forest. After investigation they were charged accordingly and put before this honorable court.
